ABSTRACT

The Bharatiya Nyaya Sanhita (BNS), 2023 is a significant milestone in the history of criminal justice in India. Intended to replace the colonial-era Indian Penal Code (IPC) of 1860, BNS seeks to indigenize criminal law and bring it in pace with the present-day realities and aspiration of people of India, including socio-cultural, technological, and constitutional frameworks. This literature review integrates the scholarly, legal, and policy critiques of BNS, analyzing its major revisions, responses, and consequences for the legal system of India.
